Elligibility after working for the Census dept.

I worked for the Census in two different quarters, but work was not fultime. Can I file for unemployment or do you have to earn a minimum amount for a long time?

I received unemployment from the start of the first layoff in my life from 9/7/08, thru 3/1/10. I went back to work for the same company that laid me off originally from 3/30/10, thru 8/31/10. I filed for a new unemployment claim and dealt with several problems getting info regarding my claim, After e-mailing Joan Hagen, ( Joan.Hagen@flaawi.com)UC Benefits Services Specialist III on Saturday, I received this response yesterday:

Our records indicate you are not eligible to receive additional benefits on claim effective 9-7-08. You have exhausted regular benefits, four federal extensions and EB. You do not qualify for a new claim effective 9-7-10 because you did not work in two calendar quarters of the base period and earn at least $3400. The base period of this claim would be April 1, 2009 thru march 31, 2010. You would not be eligible for a claim filed effective October 1 because you worked one calendar quarter in the base period July 1, 2009 through June 30, 2010.

EU8 AC= $3582 BAL= $0

E82 AC= $2418 BAL= $0

E83 AC= $2239 BAL= $0

E84 AC= $1074 BAL= $0

EB AC= $3582 BAL= $0



To be monetarily eligible you must have wages in two or more calendar quarters during the base period of your claim. The base period is the first four of the previous five completed calendar quarters prior to filing. Total wages must equal or be greater than 1.5 times the highest quarter of wages but cannot be less than $3400.

So sorry to hear you didn't qualify for benefits right now. I know January seems like an eternity away when you have no funds coming in, but did you calculate if and how much you would qualify for on January 1, when you would be able to include the income for April-May-June plus Jul-Aug-Sept? Any possibility for maybe temp Christmas work to get you through the quarter?

Other than that, you probably know that everyone here is hoping for a Tier V from either of the two bills in Congress right now. But then you also know what a nail-biting experience it is to count on that. I would assume if that did pass, you would still be eligible, I'm not certain about that, probably depends on just how the final law would be written.

Completely Confused

My recent posts about eligibility and the Letter from Joan Hagen, are now not very understandable.
It is my understanding that I was denied benefits after the letter from Joan Hagen, due to base period. Yesterday I received a letter that stated that I am required to log in and claim weeks on Mon, October 4.
Just out of curiosity I logged into AWI this morning and clicked Get Claim and Payment info, It's now showing that I have $1674.00 available, and the next date to claim is 9/13/10, I claimed on that date already, as well as the 20th of Sept.

For the past few weeks, when I logged into the AWI, to check claim and payment info, I received the message that I did not meet the monetary requirements. Now I have to re-claim the weeks I've already claimed, I don't understand?

Geesh, neither do I! Talk about a roller-coaster ride! Maybe they are still trying to figure out the new law provision for cases like yours??? Or did you really exhaust all your weeks of EB last year? Remember, they subtracted EB weeks from Tier 3 after Nov 1 last year, only to give them back to those who finished Tier 4 early this year. Who knows, maybe somebody added wrong. Let us know what happens this week!

I've been using debit cards of various types for the past year, in addition to a checking account. The debit cards, as long as they don't require a fee for payments, as it seems to be the case in the sun-sentinel article, are actually pretty handy in some ways. If it's a Visa, you can use it anywhere, including for online bill payments of some types (credit card payments excluded). FPL in southern Florida will accept debit card payments, which act like a Visa credit card, online, but with a small fee. Some online payment services like MyCheckFree.com (a free service) will allow you to use credit/debit cards for whichever vendors accept them. You have to read the fine print for a debit card, but with more and more people losing their credit in this economy, they are finding the debit cards to be more useful and even a bit psychologically freeing, in that there is no worry of going into more debt with them.

I have one Master Card debit card, which also works like a credit card, but it has some limitations with a few companies who have to call the charge in manually for it to be accepted. That card allows me to withdraw cash at banks, Bank Atlantic for example, for no fee whatsoever; it just takes the extra time to go there. Or I can use an ATM for smaller amounts of cash.

It's pretty annoying if you have to change banks, but I opened a local credit union account with very low or no fees on anything last fall, and it has been pretty good. I also hate the big banks, so it feels good to snub my nose at them. Smile

It's slightly reassuring that the state is using an American company to process these cards, but I don't completely trust that, like last year's scandal, some of those jobs aren't still being done by Indian remote workers!

Ok, I have a claim which I was collecting before I was hired and did not pass a test for this one company, claimed the money I made and claimed weeks just in case I did fail, and now its been 5 weeks that my case has been under adjudication and multiple emails sent by the csr's on the phone to make haste for resolution, still nothing, should I be worried at this point? I was working and making money with the company that hired me, they decided I didn't pass their quality tests and was let go, and was told I should be able to claim this with no problem.

Yes and keep getting told the same thing, I'm homeless now and have no car, these people don't care, and they wonder why people act and do what they do, have even sent emails to the ones on this board and have yet to hear from anyone, I give up, doing all this from my cell phone since I've had to sell everything to just eat something everyday, they can't say I haven't tried

I'm so sorry to hear of your situation. Just trying to understand, even though I've seen these kind of inexplicable situations more times than I can count in memory, are they telling you that everything is ok and you're supposed to be able to claim, or that there is a flag on your account and they are working on it and just "be patient"? Or are they all saying something different? Are you in an official appeal to a denial of benefits yet?

I'm not asking you to reveal any personal info you don't want to post, but can you tell us a little more of what they are saying? Sometimes there's just this little computer flag on an account and it floats around from desk to desk it seems, until someone actually takes responsibility for it. And I wonder if this is tied up also because you are so close to the end of your benefit year and they do a routine re-calculation when that happens to try to see if you qualify for a different weekly amount (usually less!)--but then your one-year anniversary date hasn't passed yet, so that might be unlikely.

In the meantime, are you close to any food banks or charity food providers for this emergency? I know a lot of people understandably hesitate to take that step to asking for help with food, but I've been volunteering at a local soup kitchen, and beleive me, all kinds of people are needing help to feed their families now, people who worked all their lives and never needed help. And many of the food banks have loads of food right now, many where you can just go and ask for groceries without eating in their facilities. Some actually help you get online and apply for other services as well, like food stamps. (If you're not going to get that money back-owed to you, you are probably eligible for food stamps now if you weren't before.)

I hope this gets resolved for you soon.

The problem is my case has been in an adjudication status for 6 weeks now and they have done nothing to resolve it, I am now recieving food stamps, I called yesterday and there has not been a adjudication rep assigned to my case yet, have even spoke to a supervisor and they had no clue on why nothing has happened, its getting really frustrating since they have yet to do anything and I am now homeless and without a car anymore, ill just keep claiming my weeks as instructed since they will not tell me anything about it over the phone for some reason.

On Workers comp and now laid off

Hi,

I have been on workers comp for 4 months now and have been unable to work due to the heavy restrictions that I'm on. The place I work was recently sold and I was laid off. I know that I can't receive both WC and unemployment benefits. I have no idea how long I will be on WC for and I don't want the time I have to be able to file for unemployment to run out. Can I file for unemployment while still on WC just to save my date of entitlement and then start receiving unemployment benefits after my doctor says I'm able to work?

I'm completely lost, what can I do?

I can't answer your question in regard to whether you can legally make the application while still on WC, but I can tell you that there is only a certain window of time in which your unemployment benefits are calculated. At the home page of this forum there is my earlier post on how the state calculates your unemployment benefits.

To my knowledge, this formula has not changed with the new laws; if anyone reading here has new information, please post.

But the nature of this formula and when you actually had employment earnings will determine when the "cutoff" will be in any individual case. I.e., UI claims are based on a "benefit year" of earnings. To determine the benefit year you determine the fiscal quarter you are in when you make your UI claim (Jan-March, April-June, etc.) The current quarter's earnings are discounted. AND the previous quarter's earnings are discounted. So for example, if I were to apply for UI on a new claim now, Jan 13, 2012, anything I earned in January as well as anything I earned from Oct-Dec of 2011 would be discounted, and my UI benefit year would be from Oct of 2010 through Sept of 2011. Only earnings within that period would be counted toward benefits. (For some people, waiting until the next quarter to apply can bring a better weekly benefit.)

You can go to the link to do the exact calculation for how much and how many weeks benefits will last.

On the other hand, if you previously were on unemployment before WC, found work, and then applied for UI again, depending on the timing, you might be put into one of the extended benefit tiers, i.e., you'd remain on your original benefit year, depending on whether you qualified for a new benefit year or not.

Another caveat is that with the new laws passed this summer, as the unemployment rate goes down, the number of state weeks is planned to be reduced. You can Google information on those details for the new state unemployment laws put in since Scott became governor.

Also, for anyone who is using up the last few tiers or weeks of extended benefits, when those benefits are cut off is largely in the hands of Congress, and whether or not they will continue to extend the federal tiers beyond the end of February.

Troubled Website Prompts Fla. To Withhold Payment

Sounds like somebody should remind Charlie Tuna that the previous system (a ~30yr+ old IBM Mainframe) was no symbol of technological efficiency (as the numerous problems reported on this board can verify). If I recall correctly he made no effort to fix it while he was Gov. At least the current Admin, was smart enough to negotiate penalties for failure to achieve workable functionality with Deloitte........

Interesting that Sen Nelson elected to get involved with this given the rumors that he is considering running for Gov. When the recession peaked several years ago and there were issues with people getting /receiving benefits due to the antiquated main frame and the sheer volume of applicants , and the Senator's now Democrat colleague (Charlie Christ) was Governor, my recollection is the Senator was relatively silent on this subject (as well as other EUC subjects including the 99ers). I sent him a email at the time asking him to promote extending the time limit that the unemployed could pay for health insurance from their 401K without penalty. All I got back was a non-relevant form letter about Obamacare.

Id guess given his new found interest in the unemployed, our astronaut Senator is going to run for Governor
